Introduction

Welcome to Builds and Buys! These Terms of Service (“Terms”) govern your access to and use of our website at https://buildsandbuys.com, mobile applications (iOS and Android), and all associated services (collectively, the “Platform”).

By accessing or using Builds and Buys, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Platform.

Important: These Terms constitute a legally binding agreement between you and Builds and Buys. Please read them carefully before using our services.

1. Acceptance of Terms

By creating an account, accessing our Platform, or using any of our services, you acknowledge that:

  • You have read, understood, and agree to be bound by these Terms
  • You are at least 18 years of age
  • You have the legal capacity to enter into this binding agreement
  • You will comply with all applicable laws and regulations

If you are accessing the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

  • Step-by-Step Guides: Over 1,400 pages covering building, buying, investing, and selling property
  • University Course: 144-lesson certification program across 9 modules
  • Renovation Guides: 600+ detailed cost guides across 32 categories
  • Global Investment Guides: Comprehensive guides for 198 countries, 52 US states, and 13 Canadian provinces

Professional Tools

  • Calculators: ROI, mortgage, rental property, affordability, and 30+ other professional tools
  • Document Generators: Lease agreements and other professional documents
  • Strategy Tools: Comparison calculators, market research tools, and timeline planners

Community Features

  • Real Estate Feed: Professional networking platform for collaboration and knowledge sharing
  • Profile & Dashboard: Personal account management and progress tracking
  • Mobile Apps: iOS and Android applications with full platform access

Free Access: All Builds and Buys content and tools are currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future with advance notice.

3. User Accounts

Account Creation

To access certain Platform features, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized account access
  • Accept responsibility for all activities under your account

Account Security

You are solely responsible for maintaining the security of your account credentials. We are not liable for any loss or damage resulting from your failure to protect your account information.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or any conduct we deem inappropriate, including but not limited to:

  • Providing false or misleading information
  • Violating community guidelines on the Real Estate Feed
  • Attempting to circumvent security measures
  • Harassing other users or staff
  • Using the Platform for illegal purposes

4. Real Estate University Course

Course Enrollment

Our 144-lesson university course is designed to provide professional-grade real estate education with certification upon completion.

CRITICAL COURSE RULES – READ CAREFULLY:

Completion Requirements

  • 90% Minimum Requirement: You must achieve at least 90% completion across all lessons and modules to qualify for certification
  • One Attempt Only: Course enrollment is a one-time opportunity. There are no retakes or second chances for certificate eligibility
  • Progress Tracking: All progress is tracked in real-time via Supabase database (course_enrollments, lesson_progress, module_certificates, progress_warnings tables)
  • Honest Completion: You must complete lessons honestly. Gaming the system or marking lessons complete without genuine study violates these Terms

Certificate Value and Integrity

The Builds and Buys certificate is designed to have real-world value, potentially opening doors to:

  • Better bank rates and financing opportunities
  • Government grants and incentive programs
  • Professional advancement and job opportunities
  • Industry recognition and credibility

Because of this value, we maintain strict standards: Attempting to cheat, manipulate progress tracking, or fraudulently obtain a certificate will result in immediate account termination and certificate revocation.

Certificate Issuance

Upon achieving 90% completion:

  • Your certificate will be automatically generated and available for download
  • Certificate records are maintained permanently in our database
  • Certificates cannot be transferred or reassigned
  • Fraudulently obtained certificates will be revoked and invalidated

5. Real Estate Feed Community Guidelines

The Real Estate Feed is our professional networking platform for collaboration, knowledge sharing, and community building.

Acceptable Use

When participating in the Real Estate Feed, you agree to:

  • Post content relevant to real estate education, investment, and development
  • Treat all community members with respect and professionalism
  • Provide accurate information and cite sources when appropriate
  • Respect others’ intellectual property and privacy
  • Engage constructively in discussions and debates

Prohibited Content

The following content is strictly prohibited on the Real Estate Feed:

  • Illegal Content: Content promoting illegal activities or violating laws
  • Harassment: Bullying, threats, hate speech, or discriminatory content
  • Misinformation: Deliberately false or misleading information
  • Spam: Excessive self-promotion, repetitive posts, or commercial solicitation
  • Personal Information: Posting others’ private information without consent
  • Intellectual Property Violations: Unauthorized use of copyrighted material
  • Malicious Content: Viruses, malware, or harmful code

Content Moderation

We reserve the right to:

  • Remove any content that violates these guidelines
  • Suspend or ban users who repeatedly violate community standards
  • Edit or modify content for clarity or compliance
  • Share content publicly that you post to public areas of the Feed

User Content License

By posting content to the Real Estate Feed, you grant Builds and Buys a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with the Platform. You retain ownership of your content, but you give us permission to share it with the community.

Not Professional Advice

All content on Builds and Buys is provided for general educational and informational purposes only. Our content is NOT:

  • That renovation cost estimates reflect actual costs in your area
  • That investment strategies will be profitable
  • That information is current or applicable to your jurisdiction

Any reliance you place on information from Builds and Buys is strictly at your own risk.

7. Intellectual Property Rights

Our Content

All content on the Builds and Buys Platform, including but not limited to:

  • Text, graphics, images, logos, and designs
  • Educational guides, courses, and lessons
  • Calculators, tools, and software
  • Database structure and organization
  • Trademarks, service marks, and trade names

is owned by or licensed to Builds and Buys and protected by copyright, trademark, and other intellectual property laws.

Limited License to Users

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use the Platform for personal, non-commercial educational purposes
  • Download content for offline personal use
  • Share links to our content (not the content itself)

Restrictions

You may NOT:

  • Reproduce, distribute, or publicly display our content without permission
  • Create derivative works based on our content
  • Use our content for commercial purposes
  • Remove copyright notices or attributions
  • Use automated tools (bots, scrapers) to extract content
  • Circumvent security measures or access restrictions
  • Reverse engineer or attempt to extract source code

  • AI Services: ChatGPT, Perplexity, Claude for enhanced features

Your use of these services may be subject to their respective terms and privacy policies.

9. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY – IT LIMITS OUR LIABILITY TO YOU

No Warranties

The Platform is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy or reliability of content
  • Warranties that defects will be corrected

Limitation of Damages

To the fullest extent permitted by law, Builds and Buys, its founder, employees, partners, and affiliates shall NOT be liable for:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Property damage resulting from Platform use
  • Financial losses from real estate decisions based on Platform content
  • Errors, omissions, or inaccuracies in content
  • Unauthorized access to or alteration of your data
  • Third-party conduct or content

This limitation applies even if we have been advised of the possibility of such damages.

Maximum Liability

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law. In no event shall our total liability exceed $100 USD or the amount you paid to us in the past 12 months (currently $0 as the Platform is free).

10. Indemnification

You agree to indemnify, defend, and hold harmless Builds and Buys, its founder Jules, and any affiliates, partners, employees, or contractors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your content posted to the Real Estate Feed
  • Your real estate decisions or investments
  • Any claim that your content violates intellectual property or privacy rights

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

11. Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to first contact us at jules@buildsandbuys.com (or click here to email) to attempt to resolve the dispute informally. We will work in good faith to resolve your concerns.

Governing Law

These Terms shall be governed by and construed in accordance with applicable international law and the laws of the jurisdiction where the company is registered (to be updated upon completion of company registration).

Jurisdiction

Any legal action or proceeding relating to your access to or use of the Platform shall be instituted in the courts of competent jurisdiction. You consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the “Last Updated” date at the top
  • We will notify you via email or prominent Platform notice
  • For material changes, we may require re-acceptance
  • Changes become effective immediately upon posting

Your continued use of the Platform after changes constitutes acceptance of the updated Terms. If you do not agree with changes, you must stop using the Platform.

13. Severability and Entire Agreement

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Builds and Buys regarding the Platform and supersede all prior agreements and understandings.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
