🔒 Essential Contract Elements
Every legitimate renovation contract MUST include these components
Contractor Information
- Full business name (must match license)
- License number & classification
- Insurance policy numbers
- Physical business address
- Phone, email, website
- Tax ID or business number
🚩 Red Flag Warning
If contractor uses only personal name or P.O. Box = potential scam
Detailed Scope of Work
Must specify:
- Exact work to be performed
- Materials brand/model/color
- Room-by-room breakdown
- What’s NOT included
- Cleanup responsibilities
- Permit responsibilities
Example of good detail:
“Install Kohler K-3977-0 Wellworth toilet in white, including new wax ring, supply line, and removal of existing toilet”
Payment Terms
Safe payment structure:
- Total project cost
- Payment schedule tied to milestones
- Maximum 30% deposit
- Hold 10% until completion
- Acceptable payment methods
- Late payment terms
🚩 Never Accept
• Demands for 50%+ upfront
• Cash only payments
• Full payment before completion
Timeline & Scheduling
- Start date
- Estimated completion date
- Work hours/days
- Key milestones
- Weather delay policy
- Delay penalties (optional)
Pro tip:
Include “$100/day penalty for delays beyond 30 days past completion date” to motivate timely completion
Change Order Process
Must define:
- How changes are requested
- Written approval required
- Cost calculation method
- Timeline impact
- No verbal changes clause
Sample clause:
“All changes must be documented in writing with cost and timeline impacts. No work outside original scope without signed change order.”
Warranties & Guarantees
- Workmanship warranty (1-5 years)
- Material warranties
- What’s covered/excluded
- Claim process
- Response timeframe
- Transferability
Industry standard:
• 1 year minimum on labor
• Materials per manufacturer
• Structural work: 10 years
Legal Protections
Critical clauses:
- Lien waiver upon payment
- Insurance indemnification
- Dispute resolution process
- Termination conditions
- Property damage responsibility
- Code compliance guarantee
🚩 Missing These = Walk Away
Contract without legal protections leaves you exposed to liens, lawsuits, and property damage
Permits & Inspections
- Who pulls permits
- Permit costs included?
- Inspection scheduling
- Failed inspection remedies
- Final inspection requirement
- Certificate of occupancy
Best practice:
Contractor should pull all permits and include costs in bid. You verify permits are actually pulled.

💪 Contract Negotiation Power Moves
1. Never Sign on First Meeting
Take 24-48 hours to review. Legitimate contractors expect this. High-pressure = red flag.
2. Compare 3-5 Contracts
Notice what others include that might be missing. Use best elements from each.
3. Negotiate Payment Terms
Push for 20% down instead of 30%. Hold 15% until 30 days after completion.
4. Add Penalty Clauses
$100-200/day for delays. Most contractors accept if timeline is reasonable.
5. Require Detailed Materials List
Exact brands, models, colors. Prevents inferior substitutions.
6. Include “Satisfaction” Language
“Work must be completed to homeowner’s reasonable satisfaction” gives you leverage.
